313.16(a)(1)
On 12/2/24, at approximately 1050 hours, while performing a Humane Handling verification task on HATS Categories VIII and IX, I, CSI, REDACTED observed the following noncompliance. While attempting to stun the fourth hog of the day, an establishment employee failed to render the animal unconscious with a shot from the 22-caliber rifle. Immediately after the shot the hog vocalized very loudly four times. The employee grabbed the loaded secondary gun, 410 gauge, located in the designated area and delivered a successful shot rendering the animal unconscious. Upon inspection of the head, one bullet hole was placed in a proper location and one bullet hole was placed below the right ear of the hog. This is non-compliant with 9 CFR 313.16(a)(1). REDACTED Plant manager, was notified of the non-compliance. The above-mentioned noncompliance will be associated with the NR listed in box 6a.
313.2
On November 4, 2024 at approximately 0745 hours the following noncompliance in HATS category III was observed while verifying HATS categories II and III. There were 5 hogs in pen #1 and the water container was empty. This is not compliant with 9 CFR 313.2 since the hogs didn't have access to water. Food Safety Manager REDACTED was notified of the noncompliance and it was corrected immediately. A similar noncompliance # WVU4309101328N-1 was issued on October 28th, 2024 and these noncompliances will be linked. The establishment's response to the October 28th noncompliance was that they "Will remind kill floor employees to fill water nightly and in the morning to ensure animals have water at all times." and has either not been implemented and is not effective.

On October 28, 2024, at approximately 0745 hours while verifying HATS categories I and III, I, CSI, REDACTED observed the following noncompliance: There were three (3) hogs in pen 3 that had no available water. Plant Manager, REDACTED was notified of the noncompliance. The above-mentioned noncompliance will be associated the NR listed in box 6a.

On 10/07/24, while conducting a Humane Handling task on HATS Categories VIII and IX, I, CSI, REDACTED observed the following non-compliance at approximately 1015 hours. While attempting to stun the third hog of the day, an establishment employee failed to render the animal unconscious with a shot from the 22-caliber rifle. Immediately after the shot the hog vocalized three times very loudly. The employee grabbed the secondary gun (22 magnum), locate in the designated place and loaded, and delivered a successful shot rendering the animal unconscious. Upon inspection of the head, one bullet hole was placed in a proper location and one bullet hole was placed behind the left ear of the hog. This is non-compliant with 9 CFR 313.16(a)(1). REDACTED, Plant manager, was notified of the non-compliance. This non-compliance will be linked to NR#WVU3811070525N-1, issued on 07/25/2024.

On October 2, 2024 at approximately 0815 hours while verifying HATS categories II and III the following noncompliance with category III, 9 CFR 313.2 was observed. There were 2 hogs in pen #1 that had no access to water because the container was tipped over and empty. There were also 3 beef in pen #6 that had no access to water because the water level in the 55 gallon barrel was down approximately 24 inches from the top of the barrel. REDACTED, production manager was notified of the noncompliance. There was a similar NR #WVU0210083906 issued on 8/6/2024. These noncompliances will be associated.
