Non-Compliance Description:

On 07/08/21 at approximately 1130, I, SPHV REDACTED, along with CSI REDACTED, were observing the HATS Stunning Effectiveness (Category VIII) on a beef animal with a captive bolt. The following stunning incident occurred: the animal was loaded into the chute and restrained to be stunned. The establishment uses a penetrating captive bolt for stunning. After the owner applied the first stun, the animal flinched but remained calm, while standing and blinking. There was no outward visual evidence of penetration by the captive bolt. The owner immediately applied a second stun with a firearm which was effective in rendering the animal unconscious. After skinning the skull, a short, shallow groove in the skull was present from the captive bolt stun which was adjacent to the firearm hole. I verbally informed the plant owner, Mr. Kotar, that I would contact the district office for further guidance. The District Office advised the noncompliance was non-egregious and no further action would be taken at this time. I notified Mr. Kotar that an NR would be issued for non-compliance with 9 CFR 313.15(a)(1) which requires the captive bolt stun to be applied to livestock to produce immediate unconsciousness in the animals before they are shackled, hoisted, thrown, cast, or cut.
