Non-Compliance Description:

HATS Category VIII Stunning Effectiveness At approximately 0810 hours, while performing HATS category VIII, Stunning Effectiveness, I noticed the following noncompliance: A sow was placed in the stunning restrainer and the stunner operator placed the electric stunner on the neck of the sow. The sow had a seizure, went down, but still was conscious by having her head up and looking around. The operator did not feel confident the electrical stunner was working properly so he retrieved a hand-held captive bolt gun with a small cartridge, primarily used for sheep and market hogs. The stun was ineffective in producing unconsciousness since the sow was continuing to look around and made an attempt to rise. The operator placed a larger cartridge in the same hand-held captive bolt gun and rendered the sow unconscious. On post-mortem inspection of the head, there were two holes in the skull within an eighth of inch of each other. I notified Mr. Mike Flannigan, Establishment Owner, of the forthcoming noncompliance record and that the establishment failed to render the animal immediately unconscious with the electrical stunner and captive bolt gun. I placed a US Reject tag #B40113107 on the restrainer. This is a noncompliance of 9CFR 313.30(a)(1) and 313.15(a)(1). I notified Mr. Flanigan that I would be contacting the Des Moines District Office for further guidance regarding possible enforcement action.
