On May 11, 2021 at approximately 10:30am, while assessing HATS Category VIII, Stunning Effectiveness, as part of a routine humane handling onsite visit, the following noncompliance was observed: After driving a bovine into the knock box and securing it, plant owner, Mr. David Shriver, attempted to stun the animal with a penetrating captive bolt device as he routinely does. This is a large captive bolt device that is affixed to a long handle to stun from a distance rather than a smaller handheld device. After striking the animal with the captive bolt device, the animal vocalized loudly. Mr. Shriver immediately applied a second stun with the same device. The animal vocalized loudly again. Mr. Shriver then immediately picked up his .22 caliber rifle that was available and ready for use and applied a third stun, which was effective in achieving unconsciousness. I observed this procedure from the opposite side of the knocking area where the animals drop out of the knock box to be hoisted and bled out, so vocalization was the only sign of consciousness that could be evaluated from my position. Upon observation of the head, three holes were observed, one small hole slightly higher than the target region and off center to the left, one small hole slightly off center to the right that did not fully penetrate the skull, and one large hole central in the target area. The knocking area was rejected with US Rejected Tag B30287286 until corrective actions could be proffered. This establishment does have a systematic approach to humane handling in place currently. Back-up stunning equipment was available and stunning procedures were performed as described in the plan. This represents noncompliance with regulation 9CFR 313.15(a)(1), which requires the captive bolt stunning device to be applied in a manner that achieves immediate unconsciousness. Mr. David Shriver was notified of the noncompliance and the fact that an NR would be issued.
