This is a non-compliance in connection with 9CFR 313.15 (a)(1) immediate unconscious. HATS Category VIII ‘Stunning Effectiveness’ On Wednesday, September 14, 2022 at approximately 0235, I, REDACTED CSI was on slaughter floor waiting for viscera to be presented for inspection when I witnessed REDACTED (Slaughter Floor Supervisor) standing on the edge of the knock box attempting to knock a cow that was not cooperating and putting its head in the head restraint. Mr. REDACTED was able to knock the cow with the handheld captive bolt gun and I noticed the cow close its eyes briefly then open them back up, blink and look around while thrashing in the knock box. Mr. REDACTED noticed this and grabbed the backup handheld captive bolt gun to perform a second stun but the gun did not engage. While this was happening REDACTED Slaughter Floor employee had reloaded the first handheld captive bolt gun and handed it to Mr. REDACTED who then stunned the animal the second time. This rendered the animal unconscious. After the animal was bled and the head was removed CSI REDACTED and REDACTED Owner looked at the head and found that the first knock did not even penetrate the hide, much less the skull. CSI REDACTED took regulatory control tagging the knock box until further action from the Denver District office is made. CSI REDACTED phone Dr. REDACTED and explained the situation and she verbalized concern that the handheld captive bolt gun is under powered and /or there may be storage issues with the bullets and too much humidity. Dr. REDACTED told CSI REDACTED to keep the tag on the knock box until the company presents a corrective action showing that this is not the case. Previous NR #QKJ5314053603N dated 5/3/2022 for Human Handling and Stunning Effectiveness. Slaughter Floor Supervisor, REDACTED and Owner, REDACTED were informed that the company failed humane handling and that a NR would be written. REDACTED will be completing a corrective action for the establishment and REDACTED will be writing a corrective action in conjunction with REDACTED for the Denver District and forwarding it to said parties.

HATS Category VIII ‘Stunning Effectiveness’ At approximately 12:50pm on 05/03/2022, while waiting to perform post-mortem viscera inspection on the slaughter floor; I, the SPHV, observed the following noncompliance: The Slaughter Supervisor applied an ineffective stun with a handheld captive bolt device to a beef cow. Immediately after the captive bolt device was discharged, I heard the animal vocalize and observed the animal attempt to free itself from the head restraint. The Slaughter Supervisor immediately administered an effective second stun with the readily available back-up hand-held captive bolt device that rendered the animal unconscious. I verbally informed the Slaughter Supervisor that a noncompliance record would be issued. The Denver District Veterinary Medical Specialist was notified. There are no additional noncompliance records of the same root cause within the past 90 days.

On Thursday, April 7, 2022 at approximately 6:45 a.m. CSI REDACTED stopped to check on the animals in the pends prior to operations. CSI REDACTED noticed in pen 2 the water in the trough looked like it had ice on top. Officer REDACTED then grabbed a near by hoe and put it trough the pen slats and was able to reach the water and try to stir it. The water did not stir and through further investigation, CSI REDACTED found the water to be approximately 1 inch thick not allowing access of water to the yak in the pen. CSI REDACTED took the hoe and broke up the ice allowing the animals to have a drink. Once entering the building, CSI REDACTED notified temporary Slaughter Floor Supervisor, REDACTED and owner, REDACTED of finding and of forthcoming non-compliance report. This non-compliance is in accordance with 9CFR 313.2 (e) which state "Animals shall have access to water in all holding pens..." A review or non-compliance records reveal no association to a similar non-compliance in the past 90-days.

Category VIII: Stunning Effectiveness. On November 4, 2021 at approximately 11:10 a.m. I, CSI REDACTED heard a lot of thrashing in the knock box and mooing coming from the slaughter floor. I went to investigate and found a black cow that was much smaller than the other beef cows normally slaughtered at the establishment. After approaching the stun box, I observed that the cow was standing within the restrainer and did not have its head in the head catch. I also observed that the cow had a considerable amount of blood coming from its head. The establishment employee applied a second stun to the animal with a hand-held captive bolt device which rendered the cow unconscious. Once the cow was verified to be unconscious and hoisted up, I investigated the head and observed 2 stunning wounds. REDACTED Slaughter floor employee showed me the location of the first stun. That first stun did puncture the skull by 1⁄2 inch but did not penetrate the brain. Mr. REDACTED stated that when he had the cow in the restraint for the first stun, the head catch must not have locked in properly or the animal was too small and was able to pull its head out of the restraint just as the first stun was applied. REDACTED Owner, was verbally notified of the noncompliance. Regulatory control was taken by applying US Reject Tag B-45 467572 to the stun box. Denver District Management was contacted through supervisory channels. There have been no other non-compliances for the same root cause within the past 90 days.
