313.15(a)(1)
On 8/24/2022, at approximately 0815 hours, I, CSI REDACTED was performing a Humane Handling Category VIII (Stunning Effectiveness) Task and observed the following noncompliance: An establishment employee attempted a head stun on a beef heifer in the head gate of the restrainer by discharging a hand-held captive bolt(HHCB) on the forehead area. After the (HHCB) device was discharged, it had no effect on the animal, as the heifer remained conscious and standing with blood coming out of it's nose, eye tracking the employee and did not vocalize. The establishment employee immediately reloaded the HHCB device and applied a second stun, rendering the animal unconscious. I took a regulatory control action by verbally informing Establishment Co-Owner, Mr. REDACTED that slaughter operations were ceased until preventative measures were given. Mr. REDACTED gave me verbal corrective actions and preventative measures to prevent reoccurrence and I informed him that slaughter operations could resume. During postmortem inspection, I viewed the skinned skull and observed two holes had penetrated the skull, with both holes located two inches above the eye line in the forehead of the skull, one was larger than the other. This is noncompliant with regulation 9 CFR 313.15(a)(1). I informed Mr. REDACTED and REDACTED (co-owners) of the noncompliance and issuance of the noncompliance record.

On 5/4/2022, at approximately 0845 hours, I, CSI REDACTED was performing a Humane Handling Category VIII (Stunning Effectiveness) Task and observed the following noncompliance: An establishment employee attempted a head stun on a beef heifer in the head gate of the restrainer by discharging a hand-held captive bolt on the forehead area, as he took the shot the head suddenly moved in the head gate. After the hand-held captive bolt (HHCB) device was discharged, it had no effect on the animal, as the heifer remained conscious, standing calmly, eye tracking the employee and did not vocalize. The establishment employee immediately reloaded the HHCB device and applied a second stun, rendering the animal unconscious. I took a regulatory control action by verbally informing Establishment Co-Owner, Mr. REDACTED that slaughter operations were ceased until preventative measures were given. Mr. REDACTED gave me verbal corrective actions and preventative measures to prevent reoccurrence and I informed him that slaughter operations could resume. During postmortem inspection, I viewed the skinned skull and observed two holes had penetrated the skull, with one hole located two inches above the eye line in the forehead of the skull and the other hole two inches above of the aforementioned hole. This is noncompliant with regulation 9 CFR 313.15(a)(1) and 313.15(b)(1)(iii). I informed Mr. REDACTED and REDACTED (co-owners) of the noncompliance and issuance of the noncompliance record.

On 5/4/2022, at approximately 1015 hours, I, CSI REDACTED was performing a Humane Handling Category VIII (Stunning Effectiveness) Task and observed the following noncompliance: An establishment employee attempted a head stun with a hand-held captive bolt (HHCB) device on a market hog in the cattle chute without a head restraint. After the HHCB device was discharged, it had no effect on the animal, as the hog remained conscious, standing calmly, eye tracking the employee and vocalized. The establishment employee immediately reloaded the HHCB device, had a 2nd employee steady the animal and applied a second stun, rendering the animal unconscious. I took a regulatory control action by verbally informing Establishment Co-Owner, Mr. REDACTED that slaughter operations were ceased until preventative measures were given. Mr. REDACTED informed me that their regular electric stunner was not working today and gave me verbal corrective actions and preventative measures to prevent reoccurrence. I then relinquished my control and informed him that slaughter operations could resume. During postmortem inspection, I viewed the skinned skull and observed two holes, with one hole located two inches left of center of the eye line in the forehead and the other hole, centered between the eyes penetrating the skull in the brain cavity. This is noncompliant with regulation 9 CFR 313.15(a)(1) and 313.15(b)(1)(iii). I informed Mr. REDACTED and REDACTED (co-owners) of the noncompliance and issuance of the noncompliance record.
