On Wednesday 05/11/2022 at approximately 2230 hours, I, CSI (REDACTED observed noncompliance at Leidy's Inc. Est. NO. 9520 M/P as I conducted Humane Handling inspection. Specifically, IPP observed a hog in Pen-19 with a metal-linked chain in its mouth. This metal-linked chain was comprised of approximately 15 links. From the distance, IPP perceived that the hog was sucking the metal-linked chain, but noticed that its lips were not moving, so I walked over to another area of the barn to get a closer look only to realized that the metal-linked chain was lodged in it mouth. The hog kept still, made one attempt to dislodge the chain, was unsuccessful and it remained immobilized in the same spot. IPP went back upstairs to get help. QA technician REDACTED returned with IPP to the barn. The hog was in the same position as I had seen it from the beginning of my inspection. As REDACTED and I approached Pen-19 the hogs were all startled, jumped up, ran, bumped into the affected hog and the chain was dislodged from its mouth at 2247 hours. IPP saw that the affected area of the hog's mouth bled, and that the metal-linked chain had a curved opening at its end. REDACTED removed the hogs from the pen, rolled up the metal-linked chain so that the hogs could not get to it and he guided the hogs back into Pen-19. Plant Manager REDACTED Regulatory Manager REDACTED and QA technician REDACTED are being notified in writing of the plant's failure to apply the Meat and poultry Regulations of [ 9CFR 313.1]

Non-Compliance Description:

On Monday 03/14/2022 at approximately 1839 hours I, CSI (REDACTED observed Humane Handling noncompliances at Leidy's Inc. Est. NO.9520 M/P. The noncompliance involved a truck driver who arrived at the establishment and delivered 75 Hogs. The plant's Sanitation Supervisor, Mr. REDACTED was in the yard making his rounds. IPP heard a male voice yelling loudly, hogs squealing loudly and saw the driver beating the hogs repeatedly with a paddle in the truck. The hogs were terrified and they squealed as he beat them with the paddle hurrying them to get off the vehicle. The more he beat them the louder they squealed and he would not stop so, IPP shouted...STOP, STOP, STOP but due to the combination of noise inside the truck from him and the hogs the handler could not hear me. Sanitation Supervisor Mr. REDACTED came to assist me in getting the driver's attention. He knocked on the truck. When we eventually got the driver's attention, he stuck his hear out and I told him to stop beating, stop yelling, stop stamping his feet at the animals. He asked me "What should I do?" I replied, "Stop beating them, stop screaming at them and guide them off the truck." He stopped beating the hogs, and they all came off the truck and were guided into their pens. I told the driver that moving the animals with a minimum of excitement and without excessive use of driving implements are Regulatory Requirements. I was able to observe that there were no visible injuries to the hogs. IPP informed Supervisor REDACTED and QA Technician REDACTED of the Humane Handling noncompliance. Plant Manager REDACTED and Regulatory Manager REDACTED are being notified in writing of failure to apply the Meat and Poultry Regulations of [ 9 CFR 313.2 (a) & 313.2 (b).]
