Non-Compliance Description:

On Thursday, August 4, 2022, while verifying HATS category VIII (Stunning Effectiveness), the following noncompliance was observed: The establishment stunner operator was using a Hand Held Captive Bolt (HHCB) to stun hogs. A hog was moved into the restraint, and the stunner operator attempted to stun the animal. The HHCB fired, however it sounded muffled. I observed the hog to have a small bloody circular wound in the center of its forehead. It was conscious, standing, had purposeful eye movement, and rhythmic breathing. The stunner operator immediately took the second pre-loaded HHCB from a nearby employee and stunned the hog. I observed that the hog was insensible.  I ensured that slaughter was halted until the establishment identified the root cause of the issue as being a misfire of the HHCB. Mr. REDACTED, Establishment Owner, provided verbal corrective actions, upon which time I released my verbal regulatory control action. I notified Mr. REDACTED of the forthcoming noncompliance for failure to comply with 9 CFR 313.15(a)(1).
