HATS Category V Handling of Suspect and Disabled At approximately 1315 on 3/15/2022 in the livestock barn at establishment M47788, ambulatory hogs were observed biting the ear of a non-ambulatory hog. This is noncompliant with 9 CFR 313.2(d)(1) in that the establishment failed to separate this non-ambulatory animal from the ambulatory ones. Supervisor REDACTED was immediately notified of the noncompliance and took corrective action humanely euthanize the non-ambulatory hog. He was also notified that a noncompliance record would be issued.

Non-Compliance Description:

HATS Categories: IX Consciousness on the Rail At approximately 1400 on 10-19-2021 at establishment M47788, while on the inspection stand the CSI observed the following noncompliance. A hog was head-only electrically stunned, shackled, and hoisted. The hog was not stuck after it reached the top of the elevator. The employee at the sticking station was not observed on the platform. Establishment management was also not in the area. The hog was then observed with its eyes open looking around, it began exhibiting a repeated righting reflex, then began paddling. No employees in the area took action. The employee sticking was then observed to stick the conscious animal. Immediate regulatory control action was taken by stopping production. The knock box was tagged with U.S. Rejected tag # B38 785003. This is noncompliant with 9 CFR 313.30(a)(4) in that the establishment failed in that they allowed the animal to return to consciousness. Supervisor REDACTED was immediately notified of the noncompliance and that the SPHV and the DVMS will be notified. Plant Manager REDACTED was notified via a conference call that the Chicago District Office issued a Notice of Reinstatement of Suspension (NROS) for the egregious incident. A similar noncompliance was documented on NR# GFW1215081105N dated 08/05/2021. The establishment's corrective action was ineffective in preventing recurrence of the noncompliance. Continued failure to meet regulatory requirements can lead to enforcement actions as described in 9 CFR 500.4.
