At approximately 7:10 am, I went to the pens to perform antemortem inspection. There were 5 swine in pen 6, 4 swine in pen 8 and 5 swine in pen 9 all without access to water. There were 4 bovine in pen 2 and 1 in pen 4 that did have water available. I notified Mr. REDACTED of the noncompliance. The Establishment failed to meet 9 CFR 313.2 (e) which states that animals must have access to water at all times.

HATS Category VIII: Stunning Effectiveness At approximately 7:35 am, on August 18, 2022, while observing kill floor operations at 412 Processing, I observed the following noncompliance. One beef cow was moved into the knock box and restrained in the head chute. The stun operator approached the bovine and administered the first stun, with the handheld captive bolt, which was ineffective, as evidenced by the animal remained standing and vocalized. The captive bolt fired but the rod remained extended instead of retracting as usual. The stun operator retrieved the backup .22 caliber rifle and administered an immediate and effective corrective action stun, which rendered the animal insensible, and it remained so thereafter. Establishment Owner, REDACTED was notified of the noncompliance with 9 CFR 313.15(a)(1) and 9 CFR 313.15(a)(3). The knock box was tagged with USDA Reject tag number B37579173.

The operator approached the bovine and administered the first stun, with the hand held captive bolt, which was ineffective as evidenced by conscious (sensible) vocalization, conscious tracking eye movement, and conscious righting reflex. The operator immediately reloaded and administered an immediate and effective corrective action stun which rendered the animal insensible, and it remained so thereafter. At approximately 1:50 pm, on March 16, 2022, while observing kill floor operations at 412 Meat Processing #6561, I observed the following incident. Establishment personnel moved a bull into the knocking box and restrained with the head catch. The stun operator approached the bull and administered an initial stun with a hand held captive bolt device, which was ineffective, as the animal remained standing and pulled back out of the head gate into the chute. The establishment employee operating the head chute was unable to hold the bull in place. The animal was then re-restrained with the head catch and the stun operator delivered an immediate and effective corrective action stun with the HHCB, which rendered the animal insensible, and it remained so thereafter. Mr. REDACTED, Kill Floor Supervisor and Mr. REDACTED, owner were notified of the noncompliance, and the knock box was tagged with tag number B37579187. The Establishment did not meet the regulation 313.15 (a) (1) and 313.15 (a) (3).

One beef cow entered the knock box, it was relatively calm, and restrained in the head gate. The stun operator approached the animal to stun it with a hand-held captive bolt device, and at the last second the animal turned its head causing the operator to be off center on the initial stun attempt. The animal remained standing and alert, with tracking eye movements. The stun operator reloaded the same captive bolt device, and delivered an immediate and effective corrective action stun, rendering the animal insensible, and it remained so thereafter. I had reminded the establishment they were out of feed on 10/07/21, and plant personnel stated they would take care of it. I notified Mr. REDACTED, plant owner, of the noncompliance with 9 CFR 313.2(e).
