Non-Compliance Description:

Today April, 4, 2023 at approximately 0830 hours while preforming the Livestock Humane Handling task at M-8892 I, CSI REDACTED, observed the following noncompliance. After successfully stunning 2 cattle with the normal stunning routine using a shotgun, a REDACTED company representative was present to install and demonstrate the use of a pneumatic captive bolt stunning device. The plant chose to use the device and the following happened. At approximately 0930 hours the REDACTED company representative placed the pneumatic stunner to the steers head and discharged the stunner and the steer remained conscious with responsive eyes and made loud sounds in distress. The company representative again discharged the pneumatic stunner and the steer remained conscious and in distress. REDACTED, the plant employee, immediately retrieved the shotgun and rendered the steer unconscious. After determining that the establishment followed their corrective action for this incident, I concluded that the noncompliance was non-egregious and the establishment was able to resume slaughter operations using the firearm that is normally used for stunning. Mr. REDACTED and I had a discussion and since the company representative was present today, the establishment was permitted to utilize the pneumatic captive bolt stunner again. The next animal was presented for stunning and again the company representative was trying to instruct the plant personnel in the operation of the captive bolt stunner. (1048 AM) The stunner was placed directly to the head and the trigger was pulled. The steer was not rendered unconscious, as it was responsive and made sounds of distress. The representative immediately discharged the pneumatic captive bolt a second time, but the steer remained conscious. Again, REDACTED, the establishment employee, immediately retrieved the firearm and rendered the steer unconscious. After the steer was hung to bleed and out of the way I took regulatory control action by applying USDA Rejected Tag #B-45671605 to the air control valve for the captive bolt stunner. Mr. REDACTED wanted to remove the stunner for the REDACTED company representative to inspect. I instructed Mr. REDACTED that only the shotgun could be used as the stunning method for the remainder of the day and the plants failure to follow USDA Regulations for Livestock Humane Handling with 9CFR 313.15(a)(1).
