s HATS Category VIII: Stunning Effectiveness 9 CFR 313.30(a)(3), CFR313.16(a)(1) and 9 CFR 313.16(a)(3) again HATS Category VIII: Stunning Effectiveness 9 CFR 313.30(a)(3), CFR313.16(a)(1) and 9 CFR 313.16(a)(3) On Oct.5, 2023, at approximately 6:30 a.m. I, CSI REDACTED observed an ineffective stun. The incident occurred after a steer was loaded into the restraint box. REDACTED, the Establishment Administrator, held his 20 gauge shot gun aimed at the steer and waited for him to become still. After a minute or so, he did become still and Mr. REDACTED took the shot. At that moment the steer chose to move his head several inches to the left. The steer stumbled continually for approximately 45 seconds became still and Mr. REDACTED took the second shot using the same gun that had functioned correctly. The shot was effective and rendered the animal unconscious, there was no corneal reflex. I observed a laceration approximately four to five inches in length and approximately one half inch wide on the side of the skull half way between the eye and the ear and was a surface wound. I discussed the situation with my Supervisor, FLS REDACTED. I also contacted Dr. REDACTED, SPHV. I later discussed the situation with Dr. REDACTED, District Veterinary Specialist and he agreed that it was not nescessary to tag the restraint box because the company only had the one steer to do and the restraint box would not be in use anymore that day. Dr. REDACTED instructed me to document a noncompliance and link it to the NR from 9/26/2023. Mr. REDACTED, Establishment Administrator, was notified of the noncompliance. This was a noncompliance with 9 CFR 313.30(a)(3), 9 CFR 313.16(a)(1) and 9CFR 313.16(a)(3). This noncmpliance has been linked to The NR from 9/26/2023, #WXH2109091228

The incident occurred after a large steer was loaded into the restraint box. REDACTED, the Establishment Administrater, held his 20 gauge shot gun aimed at the steer and waited for her to become still. After a couple minutes, he did become still and Mr. REDACTED took the shot. At that moment the steer chose to his head to the left slightly. The steer then stumbled continually for approximately 45 to 60 seconds before then standing still. REDACTED immediately took the second shot using the same gun and it was effective, rendering the steer unconscious. The steer had no eye movement and the tongue hung limp outside the mouth. I observed a four to five inch long laceration and approximately one half inch wide on the right side of his skull. It was a surface wound halfway between right eye and right ear. I contacted Supervisor, REDACTED. I also contacted Dr. REDACTED, SPHV. I also discussed the situation with Dr. REDACTED, District Veterinary Specialist he agreed that the restraint box need not be tagged because there was only one steer that day and the restraint box would not be in use. Mr. REDACTED, Establishment Administrater, was notified of the noncompliance. This was a noncompliance with 9 CFR 313.30(a)(3), 9 CFR 313.16(a)(1) and 9CFR 313.16(a)(3).
