Non-Compliance Description:

At 0700 hours, while observing HATS category I, Inclement Weather, and HATS category III, Water and Feed Availability, I, CSI REDACTED, observed the following noncompliance. Three plastic containers of water (1/2 of a blue 50-gallon plastic barrel) located in three holding pens respectively, were frozen. Each container had a layer of ice approximately 3”-5” thick. A total of 6 beef (5 in one pen & 1 alone) and 3 market swine in the third pen were housed overnight and did not have access to water. 9CFR 313.2(e) states in part that animals shall have access to water in all holding pens and, if held longer than 24 hours, access to feed. When notified of the non-compliance, establishment employee (slaughter worker) REDACTED immediately added warm water (two 5-gallon pails) to the surface of each frozen container, so I took no regulatory control action. I observed the three-market swine immediately drinking water as soon as it became available. REDACTED (Plant Manager) was also notified of the non-compliance at 07:15 hours.
