On July 1, 2025, at approximately 1154 hours while performing Category VIII- Stunning Effectiveness of the Humane Handling task, the following noncompliance was observed. I, CSI, REDACTED observed a stunning failure on a swine. The employee attempted to stun a swine with a handheld captive bolt stunner. When the hog stepped into the restraint it was very agitated moving its head up and down. The stun was not effective, the animal remained standing but was not vocalizing or moving around. There was a trickle of blood on the forehead from the first stun attempt, but the skull was not penetrated by the captive bolt device. The employee immediately performed the corrective action by grabbing the backup stunner from another employee and attempted the second stun which was effective. The animal after the first stun was not vocalizing or moving around. I verbally informed Mr. REDACTED of the stunning failure and that a noncompliance would be issued citing the regulation 9CFR 313.15(a)(1). The corrective actions are to be retraining of the employees on the stunning of swine.

On April 9, 2025, at approximately 1620 while performing a directed Humane Handling Task under HATS Category VIII Stunning Effectiveness the following noncompliance was observed. I was outside of the kill room in the safe area while establishment manager REDACTED attempted to stun a bull with a .410 shotgun. After the gunshot and opening the door, I noticed that the animal was still standing, breathing/snorting, with blood coming out of the forehead, and moving its head side to side. After the second gunshot, I observed the animal was still upright, breathing/snorting and moving its head side to side. After the third shot, I observed the animal was down and showed no signs of consciousness. I immediately notified the Springdale District Office management of my observations. After discussion with District Office management, I placed U.S Rejected/Retained tag # B35577140 on the knock box. Upon further investigation after the skull was skinned, three bullet holes were identified. After probing the shot placement, it was discovered that the first two shots were below and to the right of the ideal shot placement. When drawing two lines from the medial canthus to the base of the each ear, the holes were ~ 2mm below and ~ 5 mm to the right of where those lines intersect. The angle of the shot was 5 degrees to the right and 10 degrees towards the nasal cavity of where it should have been. The third bullet hole was in the back of the head behind the poll. The establishment failed to meet regulatory requirements of 9 CFR 313.16 (a)(1). Mr. REDACTED was verbally notified of the noncompliance, and this noncompliance record is being associated with NR CFV0314020812N/1 dated 2/12/2025 for the same root cause of ineffective stunning of livestock.

On February 12, 2025 at approximately 1325 hours, while performing Category VIII – Stunning Effectiveness of the Humane Handling task, the following noncompliance was observed: I was outside the kill room door in the safe area while a heifer was stunned with a .410 shot gun. I heard the gunshot. After the gunshot, I opened the door and observed the animal was standing upright, breathing/snorting, moving its head side to side. A kill room employee notified me to shut the door because a second knock was to be performed. I waited outside the door and almost immediately heard a gunshot. I opened the door and observed the second stun was effective. The second stun was performed using a .22 rifle. This was the third of five cows. Mr. REDACTED, Plant Co-Owner, was present at the time of the noncompliance. FLS, Dr. REDACTED was contacted and notified. After discussion with Dr. REDACTED, it was determined to be a non-egregious stunning failure, and no USDA hold tag was utilized. In discussion with Mr. REDACTED, he stated the cause was cow moved at the last second which caused the issue of stun placement, and the corrective action would be retraining. Upon further investigation after the skull was skinned in the area of the stuns, two bullet holes were identified. The smaller hole was at the crossing point of the medial canthus of the eye to the base of the opposite horn. The smaller hole was approximately 1 cm to 1.5 cm below and approximately 1⁄2 inch up of the larger hole. The establishment failed to meet the regulatory requirements of Title 9 CFR 313.16(a)(1). Mr. REDACTED was verbally notified of the forthcoming noncompliance. This noncompliance is being associated with NR CFV2407022707N/1 for similar cause.

On February 6, 2025 at approximately 1342 hours, while performing Category VIII – Stunning Effectiveness of the Humane Handling task, the following noncompliance was observed: I was outside the kill room door in the safe area while a heifer was stunned with a .410 shot gun. I heard the gunshot. After the gunshot, I opened the door and observed the animal was standing upright, breathing/snorting, moving its head side to side. A U.S. Retain/Reject was not placed on the knock box as this was the last inspected animal for slaughter. Mr. REDACTED Plant Co-Owner, was present at the time of the noncompliance. FLS, Dr. REDACTED was contacted and notified. After discussion with Dr. REDACTED and with no history of noncompliance as well as the immediate effective action taken by the plant employee, it was determined to be a non-egregious stunning failure. In discussion with Mr. REDACTED he stated the cause was an issue of stun placement and the corrective action would be retraining.
