Non-Compliance Description:

On Thursday, 01/09/25, at approximately 345pm, while performing a HATS Category IV inspection, I, CSI REDACTED and SPHV Dr. REDACTED observed the following non-compliance: In the establishment's livestock holding pen #4, IPP observed a 5'x5' gate that had been mounted to the southeast corner of the pen rails. The top of the gate had become dislodged and was leaning away from the rails it was attached to, creating a "V" shaped opening that was approximately two feet wide at the top by approximately 1" wide at the bottom. An overly excited bull was inside pen #4 and had placed its head into the "V" shaped opening of the attached gate. The animal's head became lodged in the opening, but it was able to free itself after a few seconds without apparent injury. IPP then informed Floor Supervisor REDACTED of the observation, and while REDACTED and IPP were evaluating the gate issue, the bull again placed its head into the "V" shaped opening, where it became lodged again. After a few seconds, the bull was again able to free itself without apparent injury. REDACTED immediately had another employee relocate the bull to livestock holding pen #3. IPP then placed US Rejected Tag NO B42071998 onto pen #4 to prevent its use until the gate was repaired. An employee remounted the gate in pen #4 to the corner rails. IPP found the gate to be secure with no openings that would cause injury to animals. At approximately 355pm, IPP removed the US Rejected tag to allow use of livestock holding pen #4. The above represents non-compliance with 9 CFR 313.1. REDACTED was informed of the noncompliance, and of the forthcoming NR.
