On 8-5-25 approximately 0700 hours I, CSI, REDACTED while conducting a HATS task truck unloading before the lambs were unloaded, I observed the same bent barbed wire from last week by the green gate pen. I notified the Plant Manager REDACTED to secure the barbed wire before unloading the lambs. When he was able to secure the barbed wire, the establishment resumed unloading the lambs and lead them to the indoor pen. I observed the pen still had broken off barbed wire pointy and rough edge around the pen it was not corrected from last week and I also observed the dirty drinking water from tub still look the bright green color with thick mattery texture. At that point I took regulatory control action and placed a U.S Rejected tag NO.B-45458350 on the gate of the outdoor pen. And the trailer with cattle had to wait to unload until the establishment could be compliant with the regulations. Approximately 0740 hours after I followed up on the outdoor pen and observed the barbed wire around the pen secure and the tub had been clean out and clean water was being refilled and I verify that livestock was not affected by these findings. I removed the U.S Rejected tag NO.B-45458350. I observed the establishment unloaded one cow and observed it walking toward the drinking water tub and it was drinking from it. I notified Plant Manager REDACTED of the forthcoming of an NR. This noncompliance is link to NR WBQ4915075230/1N and the weekly establishment meeting WBQ1415075124E. The establishment failed to comply with 9 CFR 313.1(a).

On 7-29-25 approximately 1000 hours while FSIS-USDA was conducting a Livestock Humane Handling HATS task was observing the establishment unload cattle from a trailer. Before the cattle was unloaded noticed a barbed wire approximately 4 to 5 inches long with a pointy and rough edge protruding from the pen bars approximately 2 feet off the ground on the inside pen by the green gate door where the livestock walk through. CSI immediately notified employee REDACTED before he unload the cattle if he could adjust and secure the wire to avoid a possible injury to the cattle. He was able to secure the wire. SPHV and CSI also observed that some areas of the wiring on the pen was still bent and broken off and at the time no cattle was affected. These findings were discussed during weekly establishment meeting WBQ1415075124E with REDACTED on 7-24-25 and no animals were on the premises at that time. SPHV and CSI also observed that the drinking water from the outdoor livestock pen was unclean and observed that the cattle approached it, but they did not drink from the tub. The color of the water was a fecal bright green with thick mattery texture and with several flies floating inside. FSIS-USDA personnel notified Plant Manager REDACTED of the forthcoming of an NR. The establishment failed to comply with 9 CFR 313.1(a).

At 10:55am while performing a HATS task Category III, Water and Feed, FSIS observed a cow in an outside pen at Est 2560, Whalen Meats, that did not have access to water. Per the on-site CSI, when the animal was unloaded at 10:20am for antemortem inspection, the water container was upside down and no water available. I notified the Establishment Owner/Manager, REDACTED at 11:00 am and she proceeded to provide water to the animal. No reject tags were used due to immediate corrective actions. This is a noncompliance with 9 CFR 313.2(e).
