Non-Compliance Description:

On 7/2/21 while performing humane handling tasks I observed the following: Around 1215 hours I observed a cow hanging out from the establishment’s restrainer. The cow was restrained by her hips only, during my observation the animal did not vocalize nor seem distressed. At that time the operator opened the restrainer to release the cow. When the cow was released, the back legs slipped out from under it and it fell on the “green belt” that feeds the cows up the incline rail. The cow stood back up and continued to move at a quick pace down the belt. The belt continued to run while the animal was on it. I observed the cow make its way to the end of the belt and jump off into the blood pit and fall. I immediately asked the establishment employee to close the chute door and I placed an US Reject tag #B40070133 on the door. Once the US Reject tag was placed, I summoned FLS Dr. REDACTED to the restraining area. Plant manager Raul Delgadillo and plant VP of operations REDACTED arrived, I informed them as well as Dr. REDACTED of what I had observed. An establishment employee effectively euthanized the animal by gunshot. The establishment proffered the following corrective actions, stating they would monitor 100 head each day the week of 7/5/21 as well as putting an experienced employee to operate the sides of the restrainer. A meeting was held with all employees involved in the restrainer operations. I removed US reject tag near 1350 hours, the establishment then resumed operations. This noncompliance is in failure of regulations 9CFR313.15(a)(2) and 9CFR313.2(a)
