313.16(a)(1)
HATS Category VIII – Stunning Effectiveness On 7/8/2021 at approximately 1300, while verifying stunning effectiveness, I observed the following noncompliance. The establishment was attempting to stun a steer with a .22 magnum firearm in the forehead. I left the slaughter floor and shut the door per FSIS safety protocols and heard the gun discharge. When I opened the door and re-entered the stunning area, I observed the steer was still standing upright in the stunning box with no signs of stress, no vocalization, and blood coming out of its mouth. An establishment employee told me to leave the area. After I exited the stunning area, the employee applied an immediate 2nd stun with a 357 firearm. The second stun attempt rendered the steer unconscious. After verifying that the steer was unconscious, I applied USDA tag # B11002909 on the stunning box. The dressed head was inspected, and two penetrating stun holes were observed. One of the stun attempts entered the frontal sinus but did not penetrate the cranial vault. The other stun hole penetrated successfully into the brain. The establishments corrective action is to install a head restraining device to prevent movement of the head during a stunning attempt. The regulatory control action was removed approximately at 1430 hours when the proffered corrective action was given. I verbally informed REDACTED, Slaughter Supervisor, of the noncompliance with 9 CFR 313.16(a)(1) and the regulatory control action. There have been no other non-compliances for the same root cause within the past 90 days. 313.15(a)(1) would be for captive bolts, 313.16(a)(1) is the one that covers firearm stunning.
