HATS Category III- Water and Feed Availability On June 20, 2022 at 6:22am while performing Odd-Hour humane handling verification activities at Est#: M47544, I observed the following noncompliance: In the livestock barn, pen number 7’s water bucket was empty with no water accessible to the animals. I notified Plant Owner, REDACTED, of this noncompliance. After the plant took corrective actions, the pens were reinspected and found to be acceptable at 8:25am. This is not in compliance with 9 CFR 313.2(e).

HATS Category IV- Handling During Antemortem Inspection On Tuesday June 14 at approximately 11 am while performing a humane handling task verification for Category IV the following non-compliance was observed. I noted that in pen 6 a goat's head was entrapped in the metal fencing material that is being used as a hay rack. The goat repeatedly tried to back up, then to turn its head to different angles in order to free itself, but was unable to remove its head from the opening. Mr. REDACTED was notified the goat was entrapped and was able to release the goat, it was unharmed at that time. On 4/7/22 an MOI with Mr. REDACTED noted concerns that goats could be entrapped in the wire panels being used as hay mangers in the pens, and that he planned to replace the wire paneling and would not use those pens to hold goats. Mr. REDACTED was informed that per regulation 313.1(a) unnecessary openings where the head, feet, or legs of an animal may be injured shall be repaired was found to be inadequate. His failure to repair pen 6 or to keep goats from being held in the pen resulted in a regulatory non-compliance being issued. This NR is for failure to comply with pen maintenance issues in 9 CFR 313.1 (a).

HATS Category IV: Handling During Antemortem On Friday April 1, 2022 at 7:56am while I was performing a routine humane handling task the following noncompliance was observed: “At approximately 7:56 am on Friday, April 1st, I heard the plant employees outside moving lambs into the building, so I stood up and looked out the office window to watch how the animals were being handled. I saw an establishment employee walking backwards holding a lamb by its ears and forcefully pulling it along in front of him. The lamb was on her feet and was able to take steps on her own as she was being pulled. She was resisting and trying to plant her feet, but she did take steps occasionally to move forward. I observed this occurring for at least 50 feet. The acting manager was at the back of the group of lambs, urging them forward from behind. He did not tell the employee to stop pulling the animal by her ears.” This NR will be linked to OTP3508030617N from 3/17/22. I notified the Plant Owner of this noncompliance. This is not in compliance with 9 CFR 313.2(a).

HATS Category VI –Electric Prod/Alternative Object Use On Thursday, March 17, 2022, at 8:15am while performing humane handling verification activities at Est# 47544, Food Inspector REDACTED, observed the following noncompliance. “The lamb was hoisted and the ritual cut was performed. After only a few seconds and while the lamb was still paddling and breathing, one of the employees, who did not perform the ritual cut, kicked the lamb in the nose very hard. The establishment employee made eye contact with me, smiled and proceeded the kick the lamb in the nose. The lamb flinched in reaction to the impact. I informed the employee that this behavior was unacceptable, at which point the establishment employee began laughing. I went into the office immediately and notified CSI REDACTED and Dr. REDACTED about the incident. I then placed a U.S. Rejected tag on the hoist with the number B34781864 and informed plant personnel to stop killing until further notice.” I notified, Plant Owner Mr. REDACTED, of this noncompliance. This is not in compliance with 9 CFR 313.2.

In the barn, pen 1’s water bucket was knocked over and empty. Pen 2’s bucket was empty with no water accessible to the animals. REDACTED immediately notified plant employee, REDACTED, of this noncompliance. After the plant took corrective actions, the pens were reinspected and found acceptable at 8:52am. Plant Owner, Mr. REDACTED, was then notified of the noncompliance and the establishment’s failure to adhere to the regulatory requirements of 9 CFR 313.2(e).
