At approximately 14:40 on Thursday August 4th while performing a Livestock Humane Handling verification task I, Relief SPHV REDACTED, observed the following noncompliance with HATS Category III: Water and Feed Availability: I observed two adult Holstein cows being held in the Southern-most small, corner pen adjacent to pen #2. There was no water accessible to the animals in their holding pen. I notified establishment supervisor REDACTED of my observations. Supervisor REDACTED took immediate corrective action by moving the animals to pen #5, where accessible drinking water was available. I informed Supervisor REDACTED at approximately 14:40 of the establishment's failure to meet the regulatory requirements of 9 CFR 313.2(e) and of the forthcoming noncompliance record. At approximately 14:48, I informed establishment manager REDACTED of the forthcoming noncompliance record.

HATS Category III: Water and Feed Availability On Thursday, June 2, 2022, at approximately 0845 hours, the following noncompliance was noted while I (Dr. REDACTED) was performing verification of Category III – Water and Feed Availability of the Livestock Humane Handling Verification Task. While observing pen 5, which is the pen most proximal to the truck unloading area, I noted several (approximately 10) dairy cows were present without adequate water availability. The large barrel for water in the pen was empty. The dairy cows were all standing quietly and displayed no obvious signs of distress due to the lack of water access. It is unclear how long the barrel of water had been empty. I immediately informed REDACTED, plant manager, of the issue and the forthcoming noncompliance, at which point he recruited an employee who began to fill the barrel with water. Upon returning to the pen at 0910 hours, the barrel contained an adequate amount of water for the cows. The rest of the pens had adequate water availability. Due to the lack of water in pen 5, the establishment is noncompliant with the regulatory requirement of 9 CFR 313.2(e), which states, “animals shall have access to water in all holding pens.”
