On 02/09/23 while performing a Humane Handling task I observed the following noncompliance with HATS Category III Water and Feed Availability. At approximately 10:30 hours I observed that the water bucket was tipped over and there was no water available for the hogs in the holding pen. This is a non-compliance with 9CFR 313.2(e) animals shall have access to water in all holding pens. I informed REDACTED (Manager) of the failure to comply with 9CFR 313.2(e) and notified her of the forthcoming noncompliance.

On 2/7/23 at approximately 11:05 hours, while performing a humane handling verification task of HATS category VIII, stunning effectiveness, I observed the following noncompliance with HATS category VIII. On the fifth hog of the day, while the hog was in the restrainer, an establishment employee fired one shot from a firearm (shotgun, .410 slug) to stun the animal. The hog immediately started to vocalize and both the stunner operator and I realized the hog was conscious. The stunner operator attempted an immediate second stun with the .410, to the animal which was effective and the vocalization stopped. I observed the carcass for the impact location of the stuns on the hog’s head. One wound was centered in the middle of the head approximately 3 3/8 inch above the middle of the eyes of the animal. The other stun wound was in the middle of the forehead approximately 1 1/2 inch from the middle of the eyes of the hog. I immediately took a regulatory control action to stop slaughter production and notified both REDACTED and REDACTED (establishment managers) of the observation and that this would be a noncompliance. I then immediately contacted the district office through the chain of command. After discussing with the DVMS and local area supervisor and receiving a verbal corrective action from establishment management the regulatory control action was lifted and slaughter resumed. This noncompliance is associated with NR SDM0813023502N issued on 2/2/2023 for similar cause and corrective actions given were not effective in preventing reoccurrence.
313.16(a)(1)
On 2/2/23 at approximately 09:10 hours, while performing a humane handling verification task of HATS category VIII, stunning effectiveness, I observed the following noncompliance with HATS category VIII. On the fourth hog of the day, while the hog was in the restrainer, an establishment employee fired one shot from a firearm (rifle, .22 LR) to stun the animal. A second establishment employee then reached over the bars of the restrainer to "stick" the hog for exsanguination. At this moment, the hog raised up on its front legs and vocalized. No "stick" occurred at this time as the establishment employee and I noticed the hog was conscious. The stunner operator fired an immediate second stun with the .22 LR, to the animal which was effective. I observed the carcass for the impact location of the stuns on the hog. The first shot was slightly off center of the middle of the forehead to the right side approximately 1/2-1 inch between the eyes of the animal. The second stun was directly behind the left ear of the hog. I immediately took a regulatory control action to stop slaughter production and notified REDACTED (establishment manager) of the observation and that this would be a noncompliance. I then immediately contacted the district office through the chain of command. After discussing with the DVMS and local area supervisor and receiving a verbal corrective action from establishment management the regulatory control action was lifted and slaughter resumed.
