HATS Category IV: Antemortem Inspection On Thursday March 16, 2023, at approximately 5:36am, I, SPHV REDACTED, was performing ante-mortem inspection at Banner Creek, LLC, Est. 5536, when I observed the following noncompliance. A sow was lying in pen 8B with her head stuck under the bottom round metal bar located between pens 8A and 8B. She was unable to dislodge her head or stand. As soon as the barn staff saw her condition, a captive bolt gun was retrieved to humanely euthanize her. At the time her breathing was slightly labored and when she struggled to free herself she vocalized loudly, but she otherwise had no visible injuries. She was then humanely euthanized on the first attempt. The pen bars were constructed in such a way that the animal was able to become entrapped. Therefore, the establishment failed to meet the regulatory requirements of 9 CFR 313.1(a). I notified the barn staff that a noncompliance record would be issued, the sows were removed from pens 8A and 8B, and USDA Reject tags B40 637579 and B40 637580 were applied to the pens until the establishment could provide corrective actions. At approximately 6:50am, REDACTED (Assistant QA) was also notified that a noncompliance record would be issued.

HATS Category III – Water and Feed Availability On January 4, 2023, at approximately 2:08pm, I, SPHV REDACTED, observed the following non-compliance at Banner Creek, LLC, Est. 5536. While conducting ante-mortem inspection, I noticed that the water trough located between pens 8B and 8C was completely empty. Pen 8B held no animals, but 18 sows were being held in pen 8C. There was no other source of water available to these sows. I notified an establishment employee of the empty water trough, and the trough was immediately filled. I then notified REDACTED, QA Coordinator, of the deficiency and that a non-compliance record would be issued. The establishment failed to meet the regulatory requirements of 9 CFR 313.2(e).
