On July29,2023 at approximately 1120hours I REDACTED CSI/IIC performed a Humane handling task and found a cow in holding pen#3 did not have water. I then went to the main office and informed Mr. REDACTED that the establishment would be issued a noncompliance report for failure to meet 9CFR 313.2(e) For the month of July 2023 this noncompliance report will make the third failure by the establishment to meet 9CFR313.2(e) Continued failure to comply with 9CFR regulatory requirements may result further enforcement action.

On July 25, 2023, at approximately 1058 hours. I, REDACTED CSI/IIC, was performing a human handling task of the holding pens at Establishment M47867. I observed approximately 28 lambs being held in holding pen #6. I observed one of the larger lambs panting with its his mouth open. As I walked closer to the holding pen, I observed that these lambs in holding pen #6 did not have water to drink. After questioning one of the employees as to why the lambs did not have water. I learned that the water supply to pen #6 was not working. I immediately walked back to the main office and informed Mr. REDACTED of the situation and notified him of the forth coming noncompliance report for the establishments failure to meet 9 CFR 313.1 and 313.2 On 7/14/23 as similar noncompliance report was issued record # CDK5510072514N Continued failure to comply with 9CFR regulatory requirements may result in further enforcement action.

On July 14,2023 at approximately 0658 hours while performing a Humane Handling observation of animals being unloaded from an establishment owned trailer, I, REDACTED IIC, seen a lamb on the top deck of the trailer whose hind quarter had been caught between the trailer decking and the metal rails of the trailer. As the trailer was being backed up to be unloaded. I observed the following. The trailer was very crowded. As some of the lambs were released off the trailer. I observed that an adult goat’s was laying on the floor of the trailer with it’s hind left foot was stuck in the floor planks. Her right front leg was hung in a wired panel that was placed inside the trailer. As the employees began to unload the trailer the adult goat was stepped on by the other animals coming off the trailer, she could not get up because her feet were stuck. I stopped the unloading of animals and requested that an employee release the goats’ feet so that it could get off the trailer. I informed Mrs. REDACTED the establishments general manager assistant of the forth coming noncompliance report for failure to meet 9CFR 313.2 Continued failure to comply with 9CFR regulatory requirements may result in further enforcement action.

On July 1, 2023, at approximately 9:13 hours, I REDACTED IIC, observed that there were a combination of 24 lambs and goats in holding pen # 5. There was an approximate 10’ cattle panel that had been placed inside the holding pen #5 that ran the entire length of the pen along the main structure fence that separated adjacent holding pen #6. This cattle panel was placed in a manner which only allowed the animals from Pen #6 to have access to a shared water trough for both pens. The cattle panel appeared to be placed in the holding pen to substitute a gate for the alley way that ran behind both holding pens 5 and 6. There was a gap that had been created between the alley gate way and the cattle panel. The cattle panel had not been properly secured to the main structure of the fence which allowed the cattle panel to sag into the alley way creating a small gap. Continuing my observation, I seen that there were two more goats inside the alley way. These two goats were stuck behind the cattle panel in the alley, also without water, the two goats could not find their way back into holding pen #5. The gap allowed the goats to enter the alley when they pushed against the sagging ends of the cattle panel but would not allow the animals to exit the alley when the cattle panel was pushed on from the other side of the alley way and the gap became smaller. At 9:35 hours I notified REDACTED of the forth coming noncompliance report for failure to meet 9CFR Regulation 313.2 (e) Continued failure to comply with 9CFR regulatory requirements may result in further enforcement action.

At 12:52 hours while doing antemortem inspection, I observed the following at the holding pens. Pen #4 with 2 goats with no water and no feed. Pen #7 with 42 adult goats has no water and very little feed. Pen #8 with 33 goats and sheep with no water, water trough flipped over and no feed or hay. I reported to Mr. REDACTED of Noncompliance. Mr. REDACTED immediately started fill the water troughs. This noncompliance represents a failure of the establishment to comply with FSIS regulation 9 CFR 313.2(e) which requires that water be available to livestock in all holding pens at all times, and that animals held longer than 24 hours have access to feed.
