Non-Compliance Description:

Today 7/24/2023, at approximately 0645 hrs. I CSI REDACTED, observed a large hog that had laid down in the lead up chute to the stun box and would not attempt to get up or move forward. After several failed attempts to get the hog to move the kill floor employees proceeded to knock the hog in the chute as I observed. The first knock attempt was ineffective and immediately followed with a second attempt using the first of two backup devices, which was also ineffective. At this time the hog was visibly conscious holding its head up in a sitting position. When a third attempt was made, with the second available backup device, the still conscious hog knocked the device, prior to discharging, out of the hands of the employee which then fell into the chute. The kill floor employees had to go back into the stunning box area to retrieve cartridges for the captive bolt devices which were approximately 10 to 15 feet from where the hog was sitting. Within less than a minute they reloaded both captive bolt devices and applied a third knock to the hog which was successful at rendering the hog unconscious. A fourth knock was administered as a security knock to ensure the hog did not regain consciousness. I notified the kill floor supervisor that I would be taking a regulatory control action by placing US Rejected tag No. A7627319 on the hog stun box. In addition, I notified Kill Floor Manager, REDACTED of the regulatory control action and that I would be issuing a noncompliance record for the establishments failure to meet requirements set forth in regulation 9 CFR 313.15(a)(3). This noncompliance record is not linked to any other noncompliance record.

Non-Compliance Description:

On 13June2023 at approximately 1445 hours, SPHV REDACTED was observing unloading of cattle from two stock trailers. There were no Masami employees present in the barn to receive the cattle and facilitate the unloading. The lights were not on in the barn, and the natural lighting was poor causing the animals to balk, turn around, and become excessively excited when entering the facility and driven to their pens. The two gentlemen unloading the animals were not employees of Masami and did not use excessive force or instruments inappropriately to drive the cattle. Causing livestock excessive excitement while unloading and being driven to their pens is a failure to comply with 9CFR313.2(a). Because no barn personnel were present onsite at that time, SPHV REDACTED notified Production and Safety Manager REDACTED of the noncompliance the following morning.
