HATS category VIII Humane handling; 9 CFR 313.15 (a)(1). On Thursday, September 28, 2023, at approximately 10:08 am hours; while performing Humane Handling Task in the slaughter area at establishment #M7883, Sucesion Jorge Morales, La Muda. FSIS CSI observed the following non-compliance: Inside the knocking box, captive bolt applied by establishment personnel to cow (# 883) and unconsciousness was not achieved. Establishment personnel immediately applied a second and effective captive bolt rendering complete unconsciousness. The head was removed, skinned for further evaluation. It was evident that the first captive bolt was administered at a lower angle/ineffective. Per regulation, “the stunning area shall be designed and constructed as to limit the free movements of animals sufficiently to allow the operator to locate the stunning blow with a high degree of accuracy”. The importance of a head restrainer inside the knocking box was discussed and addressed with Establishment management during the last Humane Handling Outreach and Humane Handling Inspection Verification visits by DO DVMS designee. I, Dr. REDACTED DVM, EIAO USDA-FSIS IIC, immediately notified SPHV.

During the Ante-Mortem verification I noticed that all the holding pens were without water. I immediately informed the Q.C Assistances; Ms. REDACTED and Mr. REDACTED my findings and the failure to meet the regulatory requirements of 9 CFR 313.2 (e) and the issuances of a noncompliance report.

Humane Handling Noncompliance Stunning Category: On 11/3/2022, at approximately 1145 hours while performing the Livestock Humane Handling Review and Observation task the following Noncompliance was observed: While establishment was stunning Beef (Dairy Cow with Tag.0082) with a REDACTED Product Corp .25S caliber captive stun bolt in the knock box area, the employee had a two (2) Mis-stun. On the first shot, the animal jerked its head to the side and the stun was ineffective. The establishment immediately placed a second ineffective shot at the animal. Immediately the employee placed a third effective shot rendering the animal unconscious. This action does not comply with 9 CFR 313.15 (a)(1) and 313.15(a)(3) Mechanical: Captive bolt which state “The captive bolt stunners shall be applied to the livestock in accordance with this section so as to produce immediate unconsciousness in the animals before they are shackled, hoisted, thrown, cast, or cut. The animals shall be stunned in such a manner that they will be rendered unconscious with a minimum of excitement and discomfort.” and “Immediately after the stunning blow is delivered the animals shall be in a state of complete unconsciousness and remain in this condition throughout shackling, sticking and bleeding”. Mrs. REDACTED QC Manager, was verbally notified of the above non-compliance and impending written notification.
