On August 6, 2024 at approximately 0810 hours while verifying HATS categories II and and III the following noncompliances were observed . There were 2 hogs in pen 1 with no available water. There were 2 beef animals in pen 4. The water in pen 4 was held in a 55 gallon barrel with the level of the water approximately 18 inches from the top of the barrel which would make the water inaccessible to the beef due to both beef in that pen having horns which were 6-8 inches long. Both of these above instances are not compliant with 9 CFR 313.2. Additionally, in pen 4 the metal hay rack had 2 broken rungs which were sticking out and have the potential to cause injury to an animal. This is not compliant with 9 CFR 313.1(a). Food Safety Manager REDACTED was notified of the noncompliances and they were addressed. Noncompliance #WVU2014075331 was issued July 31st, 2024 and has a similar root cause. These two noncompliances will be associated.

On July 31st at approximately 0930 hours while verifying HATS category II the following noncompliance was observed. While observing a single beef being unloaded off of the truck I noticed a green gate leaning up against the back wall of the unloading area where the animals walk into before moving towards the pens. The gate was unattached and the bottom rail was broken in half. This is not compliant with 9 CFR 313.1 because this gate has the potential to cause injury to an animal. I immediately notified REDACTED in charge of the slaughter floor, as well as Food Safety Manager REDACTED There was only a single animal to be unloaded and the noncompliance was addressed immediately.

Non-Compliance Description:

On July 25, 2024 at approximately 1030 hours the following noncompliance was observed while verifying HATS categories VIII and IX. On the third beef which was a bull, the first shot with a 22 magnum rifle did not render the animal unconscious. The bull remained standing with no obvious signs of distress. This is not compliant with 9 CFR 313.15(a)(1). An immediate secondary shot with the 410 shotgun which was pre-loaded and ready as the backup stunning device was successful in rendering the bull unconscious. The employee in charge of the floor as well as Manager REDACTED were notified of the noncompliance.
