On May 15, 2025 at approximately 0930 hours while verifying HATS categories VIII and IX the following noncompliance in category VIII was observed. On the last hog of the day REDACTED, Plant Manager, was unsuccessful in rendering the animal unconscious with the first shot with the .22 magnum rifle. This is not compliant with 9 CFR 313.16(a)(1). Per establishment protocol Mr. REDACTED reached for the .410 and was successful rendering the animal unconscious with one attempt. Mr. REDACTED was notified of the noncompliance and reject tag # B46675132 was applied to the knock box. A similar noncompliance ( # WVU0511050414N-1) was issued on May 14, 2025 and these will be associated. The corrective measures provided from the NR of 1100 hours on 5/14/2025 of " Have informed kill floor employees that for the next two weeks Plant Manager REDACTED will be doing federal shooting while they are re-trained." have not been successful in preventing recurrence of similar noncompliances.
313.16(a)(1)
On May14, 2025 at approximately 1100 hours while verifying HATS categories VIII and IX the following noncompliance with HATS category VIII was observed. On the second hog of the day the employee in charge of stunning (Ray) was unsuccessful in rendering the animal unconscious with the first stun using a .22 magnum rifle. This is not compliant with 9 CFR 313.16(a)(1). In accordance with the establishment protocol, the employee immediately reached for the pre-loaded .410 for the second attempt which was then successful in rendering the animal unconscious. All further inspected slaughter was stopped and reject tag B-46675131 was applied to the knock box. Plant Manager REDACTED was notified of the noncompliance. A similar noncompliance (#WVU5608050514N-1) was issued earlier at approximately 0930 hours on this day and these two noncompliances will be associated.

At approximately 0930 hours on May14, 2025 while performing verification of HATS categories VIII and IX the following noncompliance with category VIII was observed while stunning a heifer. The first stun attempt with a .22 magnum rifle was unsuccessful in rendering the animal unconscious. This is not compliant with 9 CFR 313.16(a)(1). Per the establishment's stunning protocol, the employee responsible for the stunning (Dave) immediately reached for the back up which was a pre-loaded .410 and took the shot which was successful in rendering the animal unconscious. REDACTED Plant Manager was notified of the noncompliance. A similar noncompliance (#WVU3711044414N-1) was issued 4-14-2025. These noncompliances will be associated. The corrective measures for the NR on 4-14-25 were "Have informed kill floor employees to make sure animal is calm and steady before taking a shot." have not been effective in preventing the same type of noncompliance from reoccurring.

On May 5, 2025, at approximately 0825 hours while verifying HATS categories II and III, I, CSI, REDACTED observed the following regulatory noncompliance: There were 9 hogs in pen #1 that had no access to water because the nipple is broken off. There were also 3 beef in pen #6 that had no access to water because the water barrel was tipped over. Slaughter Room Supervisor, REDACTED and Plant Manager, REDACTED were notified of the noncompliance.

On 4/14/25, while conducting a Livestock Humane Handling task on HATS categories VIII and IX, I, CSI, REDACTED observed the following noncompliance at approximately 0925 hours. While attempting to stun the second bovine of the day, an establishment employee failed to render the animal unconscious with the first shot from the 22-magnum rifle. After the shot, the bovine vocalized two times. The employee promptly grabbed the loaded secondary gun, 410 gauge, located next to the stunning area and delivered a successful shot rendering the animal unconscious. Upon inspection of the head, one bullet hole was in the appropriate knocking location and one bullet hole was above the right eye. This is noncompliant with 9 CFR 313.16(a)(1). Plant Manager, REDACTED was notified of the noncompliance.

On February 20, 2025, at approximately 0815 hours, while performing a livestock humane handling tasks, I, CSI, REDACTED observed two damaged sections of wood (approximately 1.5ft. by 10” ) on the bottom board between pens two and three, and one damaged section of wood (approximately 2ft. by 1ft.) on the bottom board between pens one and two providing areas that may cause injury to animals. Plant Manager, REDACTED was notified of the noncompliance.

On 01/21/25, while conducting a Humane Handling task on HATS categories I and III, I, CSI REDACTED, observed the following non-compliance at approximately 0820 hours. In the livestock holding area, all pens that contained livestock did not have accessible water provided to them. Pen #1 contained five hogs, there was ice in the water tub that was completely frozen making water not accessible. Pen #2 contained two hogs, there was ice in the water tub that was completely frozen making water not accessible. Pen #3 contained two hogs, there was no accessible water provided for the animals occupying the pen. Pen #4 contained one bovine, there was no accessible water because a thick layer of ice hindered the access to the water under the ice. Pen #5 contained 3 bovine, there was no accessible water because a thick layer of ice hindered the access to the water under the ice. Pen #6 contained one bovine, there was no accessible water because a thick layer of ice hindered the access to the water under the ice. This is non-compliant with 9 CFR 313.2. REDACTED, Plant Manager, was notified of the non-compliance. Mr. REDACTED instructed an establishment employee to bring the livestock holding area back into compliance, which was deemed acceptable by IPP as accessible water was provide to all livestock. This non-compliance will be associated with NR# WVU0511013509N-1, issued 01/09/25.

On January 9, 2025, at approximately 0810 hours while verifying HATS categories I and III, I, CSI, REDACTED and Food Inspector, REDACTED observed the following noncompliance: There were ten hogs in pen 2 that had no available water. The water container was empty. This is non-compliant with 9 CFR 313.2. At approximately 1005 hours, Food Inspector, REDACTED was performing a Humane Handling task While verifying HATS Category VIII, he observed the following noncompliance and reported to me, IIC, CSI, REDACTED. Upon attempting to stun the third hog of the day, an establishment employee failed to render the animal unconscious with a shot from the 22-caliber rifle. Immediately after the shot, the hog was trying to upright itself and its pupils were tracking. The employee immediately attained the loaded secondary gun, 410 gauge, located in the designated area and delivered a successful shot rendering the animal unconscious. Upon inspection of the head, one bullet hole was placed in a proper location and one bullet hole was placed through the right cheek of the hog. This is non-compliant with 9 CFR 313.16(a). At approximately 1020, while I, IIC, CSI, REDACTED and Food Inspector, REDACTED was verifying HATS Category VIII and IX, the following noncompliance was observed: While attempting to stun the fourth hog of the day, an establishment employee failed to render the animal unconscious with a shot from the 22-caliber rifle. Immediately after the shot the hog was trying to upright itself and its pupils were tracking. The employee grabbed the loaded secondary gun, 410 gauge, located in the designated area and delivered a successful shot rendering the animal unconscious. Upon inspection of the head, one bullet hole was placed in a proper location and one bullet hole was placed above the right eye of the hog. Since this was the second occurrence of the day, occurring back-to-back, immediate regulatory action was taken, and slaughter operations were halted. This is non-compliant with 9 CFR 313.16(a)(1). Plant Manager, REDACTED and Slaughter Supervisor, REDACTED were notified of the noncompliance.

On 12/2/24, at approximately 1050 hours, while performing a Humane Handling verification task on HATS Categories VIII and IX, I, CSI, REDACTED observed the following noncompliance. While attempting to stun the fourth hog of the day, an establishment employee failed to render the animal unconscious with a shot from the 22-caliber rifle. Immediately after the shot the hog vocalized very loudly four times. The employee grabbed the loaded secondary gun, 410 gauge, located in the designated area and delivered a successful shot rendering the animal unconscious. Upon inspection of the head, one bullet hole was placed in a proper location and one bullet hole was placed below the right ear of the hog. This is non-compliant with 9 CFR 313.16(a)(1). REDACTED Plant manager, was notified of the non-compliance. The above-mentioned noncompliance will be associated with the NR listed in box 6a.

On November 4, 2024 at approximately 0745 hours the following noncompliance in HATS category III was observed while verifying HATS categories II and III. There were 5 hogs in pen #1 and the water container was empty. This is not compliant with 9 CFR 313.2 since the hogs didn't have access to water. Food Safety Manager REDACTED was notified of the noncompliance and it was corrected immediately. A similar noncompliance # WVU4309101328N-1 was issued on October 28th, 2024 and these noncompliances will be linked. The establishment's response to the October 28th noncompliance was that they "Will remind kill floor employees to fill water nightly and in the morning to ensure animals have water at all times." and has either not been implemented and is not effective.

On October 28, 2024, at approximately 0745 hours while verifying HATS categories I and III, I, CSI, REDACTED observed the following noncompliance: There were three (3) hogs in pen 3 that had no available water. Plant Manager, REDACTED was notified of the noncompliance. The above-mentioned noncompliance will be associated the NR listed in box 6a.

On 10/07/24, while conducting a Humane Handling task on HATS Categories VIII and IX, I, CSI, REDACTED observed the following non-compliance at approximately 1015 hours. While attempting to stun the third hog of the day, an establishment employee failed to render the animal unconscious with a shot from the 22-caliber rifle. Immediately after the shot the hog vocalized three times very loudly. The employee grabbed the secondary gun (22 magnum), locate in the designated place and loaded, and delivered a successful shot rendering the animal unconscious. Upon inspection of the head, one bullet hole was placed in a proper location and one bullet hole was placed behind the left ear of the hog. This is non-compliant with 9 CFR 313.16(a)(1). REDACTED, Plant manager, was notified of the non-compliance. This non-compliance will be linked to NR#WVU3811070525N-1, issued on 07/25/2024.

On October 2, 2024 at approximately 0815 hours while verifying HATS categories II and III the following noncompliance with category III, 9 CFR 313.2 was observed. There were 2 hogs in pen #1 that had no access to water because the container was tipped over and empty. There were also 3 beef in pen #6 that had no access to water because the water level in the 55 gallon barrel was down approximately 24 inches from the top of the barrel. REDACTED, production manager was notified of the noncompliance. There was a similar NR #WVU0210083906 issued on 8/6/2024. These noncompliances will be associated.
