On May 23 , 2024 at approximately 11:45 I , CSI REDACTED, observed the stunning effectiveness of a large steer, approximately 2,000lbs, presented for slaughter. The steer was very broad and did not fit into the head restraint correctly. Establishment employee REDACTED attempted to use a captive bolt to stun the steer with its head moving freely without restraint. I, CSI REDACTED, observed Mr. REDACTED deliver the first stun with the captive bolt. After the initial stun the beef was still standing. Mr. REDACTED immediately grabbed the backup firearm, a 40 caliber pistol, to deliver a second stun. I, CSI REDACTED, stepped outside the kill floor as Mr. REDACTED prepared to deliver the back up stun. I, CSI REDACTED, heard one shot and stepped back onto the kill floor and observed the steer unconscious and insensible to pain. I informed Mr. REDACTED that an NR would be forth coming and he verbalized an understanding of this. The establishment has failed to meet the requirements of 9CFR 313.15(a)(1) which states that the captive bolt stunners shall be applied to the livestock in accordance with this section so as to produce immediate unconsciousness in the animals before they are shackled, hoisted, thrown, cast, or cut. The establishment has failed to meet the requirements of 9CFR 313.15(a)(3) which states that Immediately after the stunning blow is delivered the animals shall be in a state of complete unconsciousness and remain in this condition throughout shackling, sticking and bleeding. The establishment has also failed to meet the requirements of 9CFR 313.15(b)(1)(iii) which states that the stunning area shall be so designed and constructed as to limit the free movements of animals sufficiently to allow the operator to locate the stunning blow with a high degree of accuracy. After reviewing non compliance records from the past 90 days, this non-compliance will be associated with NR # DTB0715042511N-1 issued on 4/9/2024 for ineffective stunning of a large boar with a firearm.
313.16(b)(2),313.16(a)(3),313.16(a)(1)
On April 8, 2024, at approximately 1240, IPP REDACTED observed the stunning effectiveness of a very large gilt, approximately 800 pounds, presented for slaughter. Mr. REDACTED used a .22 mag pistol to shoot the gilt for stunning purposes. IPP REDACTED stood outside of the Kill Floor while the gun was in use, after the first shot IPP REDACTED stepped inside the Kill Floor and observed that the gilt was still standing, and that the firearm chosen was not effective as to cause immediate unconsciousness. Mr. REDACTED immediately applied a second shot rendering the gilt unconscious. IPP REDACTED verbally informed Mr. REDACTED that the application of live ammunition from the firearm failed to produce immediate unconsciousness of the animal by a single shot and a noncompliance would be issued. Due to this employee's inability to produce an effective stun with the first shot this establishment has failed to meet the requirements in 9 CFER 313.16(a)(1) which states: The firearms shall be employed in the delivery of a bullet or projectile into the animal in accordance with this section so as to produce immediate unconsciousness in the animal by a single shot before it is shackled, hoisted, thrown, cast, or cut. The animal shall be shot in such a manner that they will be rendered unconscious with a minimum of excitement and discomfort; 313.6(a)(3) which states: Immediately after the firearm is discharged and the projectile is delivered, the animal shall be in a state of complete unconsciousness and remain in this condition throughout shackling, sticking and bleeding; and 9 CFR 313.16(b)(2) which states: Special requirements. Choice of firearms and ammunition with respect to caliber and choice of powder charge required to produce immediate unconsciousness of the animal may vary depending on age and sex of the animals. Mr. REDACTED will be notified in writing upon receipt of this Noncompliance Record. Upon reviewing the previous ninety days of records it has been determined that there are no other similar NR's written for the same root cause.
