Non-Compliance Description:

HATS Category VIII - Stunning Effectiveness On December 18, 2024, at approximately 0903 hours, I SPHV REDACTED, observed the following noncompliance. Establishment owner REDACTED restrained a small beef cow in the head catch, using a swing gate to place pressure along the animal’s flank, like a squeeze chute, and informed USDA FSIS that they would be stunning the animal with a 40-caliber firearm. I, along with CSI REDACTED and CSI REDACTED, moved around the corner behind the concrete wall to remain out of the line of the shot. The shot rang out and I took approximately 10 steps to enter the kill area. The cow was still standing, swinging its head back and forth looking around the room. Mr. REDACTED then called out and fired a second shot, at which time the cow dropped to the floor insensible. After removal and skinning of the head, it was obvious that the first shot was not centered, and had hit the cow in the sinus, between the center of the forehead and the right eye. The second shot was very close to center and had entered the brain. I informed establishment Manager REDACTED of the forthcoming noncompliance and the failure to meet the requirements of 9 CFR 313.16(a)(1).
