Non-Compliance Description:

HATS Category VII- Observation for Slips & Falls On Wednesday March 19, 2025, at approximately 9:30am, while performing routine Humane Handling Verification activities at Est. M9548, the Food Inspector observed the following noncompliance: The establishment unloaded a dairy cow from a trailer. Upon exiting the trailer, the cow was calm and walked into the pen that was straight across from the trailer. The pen and adjacent walkway are flat, nontextured concrete flooring and in this case had a lack of bedding in that local area. The cow then turned around to exit the pen and a plant employee used an electric prod on her back. The dairy cow reacted to the prod with a sharp jerking motion and slipped and fell in the opening of the pen with her right hind leg pinned behind her. Two FSIS inspectors observed the cow on the ground vocalizing. The establishment then spread more grit on the ground, freed her hind leg, and the cow was able get up and walk to the kill box. The establishment owner was notified of the noncompliance and the establishment’s failure to adhere to the regulatory requirements of 9 CFR 313.1(b).
