HATS VIII: Stunning Effectiveness On 09/21/21 at approximately 0810 hours, I, CSI REDACTED, observed the following noncompliance. Two market hogs were in a stock trailer, and establishment employees were preparing to stun one for slaughter using a .22 caliber long rifle. Dr. REDACTED, SPHV, and I were standing in the firearm safety zone behind the door of a shipping container. After a first shot was fired, we immediately heard a hog squealing and a loud yell from Mr. Rob McKenzie, Owner, who had fired the rifle. As Dr. REDACTED and I peered around the door of the shipping container Mr. McKenzie and Mr. James Stoll, Owner/Manager, exited the trailer while a hog was still squealing. After approximately 15-30 seconds, Mr. Stoll told Mr. McKenzie that the gun was still loaded and to fire another shot. After the second shot, a hog continued to squeal. Another 30 seconds passed, and Mr. Stoll ran out of the trailer and into the shipping container where Dr. REDACTED and I were standing to grab the captive bolt gun. He then ran back to the trailer with the captive bolt gun to administer another stunning attempt. I heard the captive bolt discharge, and afterwards the squealing stopped. Mr. Stoll and Mr. McKenzie proceeded to remove the hog from the trailer onto the bleeding slab, where Dr. REDACTED and I verified the hog was unconscious. I notified Mr. McKenzie that I would be tagging the trailer with the remaining hog and no further stunning would be allowed. I placed Rejected Tag #B26819361 on the trailer. Prior to the establishment skinning the head of the hog, I discovered an exit wound under the jaw of the animal. I was only able to find one hole consistent with the use of the captive bolt device on the forehead. Upon inspection of the skinned head, I observed the rifle holes were approximately an inch below the eyes in the central mid-line of the head, while the captive bolt hole was above the eyes. This event was an egregious noncompliance to 9 CFR 313.15 regulations and resulted in an Administrative Enforcement Action (Notice of Suspension).
