313.15(a)(1)
On 04/29/2021 at approximately 12:44hrs while performing routine observation for Livestock Humane Handling. Inspection Plant Personnel (IPP) observed the following noncompliance with stunning. While verifying HATS category, VIII-Stunning Effectiveness, IPP observed stunning operator, REDACTED, attempt the stunning on the last beef cow of the day at approximately 12:44. The first attempt using the compressed stunning device failed to render the animal unconscious. IPP noted the animal did remain standing. The stunning device recoiled back, and the cow’s eye reacted to the first stunning attempt. The cow was breathing normally, eye tracking movement was noted, and there was no vocalization. During the observation IPP noted adjustments made to the head restraint cradle for the head was angle high. The animal was pushed forward through the chute to the point the top neck restraint was aligned with near the cow’s front should blades. After hide removal IPP could clearly see approximately 1⁄2 inch ringed indentation from compressed stunning rod to the high upper right from center of cranial where the first stunning attempt was made. The stunning operator informed Supervisor, REDACTED. Mr. REDACTED instructed the stunning operator to grab the back-up hand-held captive bolt gun. The first back-up gun failed to operate due to no cartridge. The second back-up captive bolt gun was used and after approximately 10 seconds the second attempt rendered the cow fully unconscious. IPP took Regulatory Control Action (RCA) and affixed U.S. Reject tag#B41949023 to the squeeze chute to prevent further stunning until the cause and corrective action could be determined. After proffered corrective action were made IPP released the squeeze chute at approximately 15:00hrs after corrective were discussed. IPP informed Mr. REDACTED and Regulatory Manger, REDACTED of the noncompliance. The establishment is noncompliant with 9 CFR 313.15(a)(1), because the first stunning blow failed to render the animal in a state of immediate unconsciousness. The first attempt using the hand-held captive bolt gun failed to render the animal unconscious. IPP noted the animal did not drop to its stomach and remained standing. The animal was breathing normally, eyes tracking movement, and there was no vocalization. IPP could clearly see a hole to the right side of cranial above center where the first stunning attempt was made. The stunning operator informed Supervisor, REDACTED. Mr. REDACTED instructed the stunning operator to grab the back-up hand-held captive bolt gun and after approximately 10 seconds the second attempt rendered the heavy calf fully unconscious. IPP took Regulatory Control Action (RCA) and affixed U.S. Reject tag#B41949026 to the squeeze chute to prevent further stunning until the cause and corrective action could be determined. After proffered corrective action were made IPP released the squeeze chute at 13:01hrs. IPP informed Mr. REDACTED of the forthcoming noncompliance. The establishment is noncompliant with 9 CFR 313.15(a)(1), because the first stunning blow failed to render the animal in a state of immediate unconsciousness.
