On 10-27-2021 I, CSI REDACTED, observed the following noncompliance at establishment M19697: At approximately 1401hours while performing ante-mortem inspection, I observed I piece of wire fence broken and hanging from the fence of the scale holding pen. I asked about the broken fence and was told the establishment knows. I went and gained the attention of Ms. REDACTED, Quality Assurance Supervisor, and showed her the broken fence with the hanging piece. I informed her that a noncompliance record would be documented. I was informed the fence would be fixed over the weekend, but they could not remove the hanging piece. Ms. REDACTED had the four cows removed from the scale holding pen. I applied U.S Rejected tag B35200152 to the scale holding so it would not be used until the fence can be fixed. No livestock was injured or hurt. The establishment failed to comply with 9 CFR 313.1(a) by leaving the piece of broken fence to hang and swing freely. 9 CFR 313.1(a) states “Livestock pens, driveways and ramps shall be maintained in good repair. They shall be free from sharp or protruding objects which may, in the opinion of the inspector, cause injury or pain to the animals. Loose boards, splintered or broken planking, and unnecessary openings where the head, feet, or legs of an animal may be injured shall be repaired.” A review of the establishment’s records indicates no noncompliance record of a similar root cause.
