On 12-13-2023 I, CSI REDACTED, observed the following noncompliance at establishment M19697: At approximately 0704hours while performing ante-mortem inspection, I observed the bottom plank of the fence to pen #4 was being held up by a piece of wire. It was dangling freely from the other plank. They had more than 10 goats in the pen. I told them they could not have the animals in this pen until that plank was fixed. I went and rejected the pen and applied US Rejected tag B35200159. I went back to see if they had fixed the fence around 1300. I was outside when USDA Food Inspector REDACTED stated, “look at this hole in the fence”. I walked over to the scale and saw a cow putting its head through the hole in the back part of the pen with the scale. I immediately took regulatory control, had them remove the four cows from the pen and applied US Rejected tag B38504645 to the door. I then informed Mr. REDACTED, General Manager, that a noncompliance record would be documented for the hole in the pen with the scale and the broken hanging plank of pen #4. No livestock was injured. The establishment failed to comply with 9 CFR 313.1(a) by leaving the piece of broken fence to hang and swing freely. 9 CFR 313.1(a) states “Livestock pens, driveways and ramps shall be maintained in good repair. They shall be free from sharp or protruding objects which may, in the opinion of the inspector, cause injury or pain to the animals. Loose boards, splintered or broken planking, and unnecessary openings where the head, feet, or legs of an animal may be injured shall be repaired.” The establishment fixed the pen with the scale and the tag was removed approximately 1345pm. Pen #4 was fixed, and the tag was removed approximately 1430pm. Both pens were back in compliance. A review of the establishment’s records indicates no noncompliance record of a similar root cause. This document serves as written notification that your failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action.

Non-Compliance Description:

At approximately 2:59pm on November 7th, 2023, I found a Humane Handling noncompliance at M19697. While performing ante mortem, I noticed nine calves in a pen without water. Supervisor REDACTED was notified of the noncompliance. The establishment did not meet regulation 9 CFR 313.2(e) which states, “Animals shall have access to water in all holding pens...” Water was placed in the pen. The establishment will be monitoring the pens for the next 3 weeks to make sure all pens have water.
