Non-Compliance Description:

HATS III: Water/Feed, Stocking Density On December 20, 2021 at 1050 hours while inspecting livestock on the premise, I CSI REDACTED, observed the noncompliance. When I walked up to pen 4, I observed 4 lambs in a pen with a trough of water that had about a 1/4-inch-thick layer of ice on the top of it. I felt the ice to determine if it was broken so the animals could drink from it, and after applying some pressure the ice broke into pieces. I also observed broken ice next to the water trough that was approximately 1 inch thick. I then went to pen 3, which had 5 lambs in it, and observed that the water trough was also frozen, and that broken ice was also next to it. Pen 1 had 5 lambs in it and it also had a frozen water trough. I went and informed plant manager REDACTED that the water troughs were frozen and that an NR would be issued for the noncompliance. Additional lambs were unloaded by an employee at 1100 hours. The employee made sure the trough of water in the pen for the arriving lambs was unfrozen and then went and broke the ice in the water troughs of the other pens. This does not meet the regulatory requirements of 9 CFR 313.2 (3) (e) which states: Animals shall have access to water in all holding pens.
