Non-Compliance Description:

On May 13, 2024, at 0700 hours, I SPHV Dr. REDACTED observed the following noncompliance with HATS Task IV “Facilities” during antemortem inspection. While I was performing a Humane Animal Handling task (HATS Task) at Establishment M47488, I observed that one of the rods that is approximately half an inch in diameter, approximately 3 inches in length and is welded onto the fencing in pen one had become bent, and it was protruding into the pen, which held 1 USDA lamb. Although there was a water trough tied to this same area, the rod was short enough to prevent any direct injury to the livestock being held in this pen. At Approximately 0705 hours, I informed Plant Manager REDACTED of the forthcoming noncompliance. The above is not in compliance with 9 CFR 313.1(a). Following a review of previous noncompliance records issued within the last 90 days, this noncompliance will not be associated as there are no other noncompliance records of similar cause or circumstance. Per 9 CFR 313.1 (a); Livestock pens, driveways and ramps shall be maintained in good repair. They shall be free from sharp or protruding objects which may, in the opinion of the inspector, cause injury or pain to the animals. Loose boards splintered or broken planking, and unnecessary openings where the head, feet, or legs of an animal may be injured shall be repaired.
