This morning (04/04/22) approximately at 0720 hrs., while performing ante-mortem at the establishment Pen areas, the following noncompliance was observed. Pens #23 and # 24 (one next to the other) were observed with missing tubes (four galvanized iron tubes) from the walls and one tube (galvanized iron) that supports the walls, and the roof is broken and with exposed sharp areas. At the time of my observation four Beef Cows were observed in pen #24, but none were observed with physical damage. Pens area personnel immediately moved the animals to another pen. Both pens were immediately Rejected with US Rejected tags: No. B43289937 (Pen #24) and B43 276544 (Pen #23). This does not comply with 9CFR section 313.1 (a). This sections states that; 313.1(a): Livestock pens, driveways and ramps. (a) Livestock pens, driveways and ramps shall be maintained in good repair. They shall be free from sharp or protruding objects which may, in the opinion of the inspector, cause injury or pain to the animals. Loose boards, splintered or broken planking, and unnecessary openings where the head, feet, or legs of an animal may be injured shall be repaired. Mrs. REDACTED QA Supervisor and Mr. REDACTED, Pen area Supervisor were shown and notified of my findings and for the necessary corrective measures. This document serves as written notification that your failure to comply with regulatory requirements could result in additional regulatory or administrative actions.

On 12/06/2021 at 0730 hours approximately, while performing the Livestock Human Handling Task during the Ante-mortem inspection, I observed the following non-compliance: The Sows were received on 12/01/2021 and the animals were placed in the pen #16. The Sows were fed on 12/02/21 – 10:00am, 12/03/21 – 10:00 am, 12/04/21 – 10:00am and was the last feeding registered in the document " Monitoreo de Alimentos in los Corrales". On 12/06/21 the documents review was performed during the ante-mortem inspection and I was able to observe that no evidence of the feeding of the sows for the date 12/05/21. Also, the pen #16 was carefully observed and the floor did not present food residues. REDACTED (guard on-site) proceeded to feed the sow on 12/06/2021 at 7:57 am approximately. Total time: 45:57 hours/minutes without food (exceeding 24 hours). The establishment staff did not present written evidence of the feeding. I verbally informed to Mr. REDACTED (QC Manager) of the noncompliance.
