HATS Category III - Water and Feed Availability. On July 15, 2021 at approximately 10:05 am while performing humane handling verification activities CSI REDACTED, SPHV REDACTED and visiting FLS observed the following noncompliance. A cow with the ear tag number 7 was located in a small holding pen in the barn near the ramp with no access to water. The plant employee previously moved this cow in the knock box and elected to back the cattle out into alleyway following difficulty with compliance getting the cow’s head into the head restraint. The gate to the enclosure where the cow was held was open giving access to the alleyway leading to the knock box, however there was no possibility for access to water at this location. The plant owner Mr. Andrew Pudliner Sr. was immediately notified of this noncompliance. No regulatory control action was taken at this time as the employee took immediate corrective action by moving the cow with tag# 7 out of the alleyway into the bigger pen#1 where it would have access to water. This is a failure to comply with regulation 9CFR 313.2 (e) Handling of livestock.

HATS Category VIII - Stunning Effectiveness On June 11, 2021 at approximately 10:24am, while performing humane handling verification activities, CSI REDACTED, CSI REDACTED, and SPHV Dr. REDACTED observed the following noncompliance. The plant employee moved a boar swine in the knock box for stunning. The primary stunning operator fired using the 0.410 firearm and hit the swine in between the eyes, but the boar swine remained standing. The backup stunner (plant owner) was nearby holding the back up 20-gauge stunning implement, which he then handed up to the primary stunner before he exited the slaughter floor. The primary stunner waited for the animal to stop moving its head then made the second shot with the 20-gauge. The boar dropped and was shackled and hoisted for sticking/bleeding. Examination of the skull revealed 2 holes in the forehead of the animal. This observation confirmed that the first stunning attempt did not effectively render immediate unconsciousness. The first stun left a hole which was not fully penetrated by the .410 bullet. The second stun left a larger hole approximately 2.5-3 inches below the first hole. This second hole was fully penetrated by the 20-gauge bullet. Regulatory control action was applied to the knock box US Retain tag# B45023591 and FLS and DVMS were notified. Plant Owner was notified of the Noncompliance and the establishment’s failure to adhere to the regulatory requirements of 9CFR 313.16 (a)(1)
