HATS Category II – Truck Unloading On August 17, 2022, at approximately 0710, while performing humane handling verification activities, CSI REDACTED observed a plant employee guiding a truck to back up to unload animals off into the pens. The trailer was not properly backed up against the loading dock. The trailer was at a bit of an angle with one side of the bumper close to the dock and the other side away from the dock approximately 8-12 inches. The employee opened the door to unload the first group of animals. A red and white Bovine was coming off the truck, and as the bovine stepped off the trailer onto the loading dock, her back foot got stuck in the gap between the trailer and loading dock, and the bovine fell completely down onto her ventrum, with her leg down through the gap. The plant employee immediately informed the truck driver to move the truck forward so she could be released. As she was released, she immediately stood up on her own and was limping as she walked into the pen. When she was standing still, she favored the right hind limb by bearing little to no weight on it. There were no visible wounds or blood on the affected leg. CSI REDACTED immediately notified the supervisor Dr. REDACTED of the situation as well as informed the plant employee of this noncompliance. No regulatory control was taken at this time due to the employee took immediate corrective action by having the driver move the truck forward, the bovine was able to release and rise on her own, and continued ambulatory down the ramp and into the pen. This is a failure to comply with the regulation 9 CFR 313.1 (a) and 313.1(b).

Category III Water and Feed Availability Category I Inclement Weather On 11/24/21 at 0703 hours while performing the review and observation component of the humane handling task the following noncompliance was observed. A dairy cow was observed in holding pen two. The two water barrels outside of pen two were frozen on top allowing no access to water. Establishment employees on hand at the time were notified verbally. This is noncompliance with 9 CFR 313.2. A search of PHIS showed that similar noncompliances were issued 11/19. 11/22, and 11/23 concerning water availability.

Category III Water and Feed Availability On 11/23/21 in the barn area of the establishment while performing the review and observation component of the humane handling slaughter task the following noncompliance was observed. At 0708 hours a pig was observed in the runway/unloading ramp area with no water available at the time of observation. Also in the inside pen area a swine and two sheep were being held with no access to water. Containers were available in the pens but, water was not available at the time of observation. Establishment employees were notified and water was put into the containers at approximately 0725. Mr. REDACTED was immediately notified verbally. This is noncompliance with 9 CFR 313.2. A search of PHIS showed recent similar noncompliances were issued 11/22 and 11/19.

Category III Water and Feed Availability On 11/22/21, at 0708 hours while performing the review and observation component of the humane handling procedure the following noncompliance was observed. A swine was observed in pen number one. No water was available at the time of observation. A container was in the pen but, was empty. Mr. REDACTED was notified verbally. The swine was eventually moved to another pen and provided water. A similar noncompliance was documented 11/19/21. This is noncompliance with 9 CFR 313.2.

Category III Water and Feed Availability On 11/19/21 in the barn area of the establishment while performing the review and observation component of the humane handling slaughter task the following noncompliance was observed. At 0705 hours a pig was observed in pen number one with no water available at the time of observation. Also in the adjacent unloading area a swine was being held with no access to water. Containers were available in the pens but, water was not at the time of observation. Establishment employees were notified and water was put into the containers at approximately 0825. At 1025 hours it was observed that the swine in pen number one did not have access to water. The container was in the pen but, had been turned over. Mr. REDACTED was immediately notified verbally. This is noncompliance with 9 CFR 313.2.

HATS Category VII Slips and Falls On 11/9/21 at approximately 0745 hours, while verifying HATS Category II – Truck Unloading, the following noncompliance with the regulatory requirements for slip resistant flooring was observed. Food Inspector REDACTED observed the following noncompliance. In the barn area cattle were being unloaded from a truck. The cattle walked down the ramp and as they tried to slow at the bottom the cattle slipped and fell with their bodies coming into contact with the floor of the pen. No animal sustained injury as a result. Mr. REDACTED was notified verbally by Consumer Safety Inspector REDACTED of the noncompliance. The unloading ramp was rejected with US reject tag no. B45023611. This is noncompliance with 9 CFR 313.1b. A search of PHIS did show a recent similar noncompliances issued on 11/4/21 number CGN3307112604N-1.

HATS Category VII Slips and Falls On 11/3/21 at approximately 0915 hours, while verifying HATS Category II – Truck Unloading, the following noncompliance with the regulatory requirements for slip resistant flooring was observed. Food Inspector REDACTED observed the following noncompliance. In the barn area cattle were being unloaded from a truck. The cattle crossed over pen one into pen two. In pen two, two of the cattle slipped and fell with their bodies coming into contact with the floor of the pen. No animal sustain injury as a result. Mr. REDACTED was immediately notified verbally by trainer Consumer Safety Inspector REDACTED of the noncompliance. Upon examination of pen two no anti-slip type product had been added. No regulatory control action was taken at the time because no more animals were being unloaded. This is noncompliance with 9 CFR 313.1b. A search of PHIS did not show any recent similar noncompliances.
