313.16(a)(1)
On 9-13-22 at approximately 7:50 am while performing verification of HATS category VIII the following noncompliance was observed. When attempting to stun the second beef of the day with a 22 rifle and 22 magnum shell, the first attempt did not render the animal unconscious. This is not compliant with 9 CFR 313.16(a)(1). The animal was standing in the knock box and the bullet had not penetrated the skull. There was gunpowder observed on the hair in the proper area for a stun. Mr. REDACTED, owner and employee responsible for stunning, immediately loaded the gun with a 22 magnum shell from a brand new box of shells and the second attempt results were the same as the first. The third attempt was successful in rendering the animal unconscious. Mr. REDACTED was verbally notified of the noncompliance. A similar noncompliance was issued on 8-16-22, #XQC2510082517N/1.

On 8-16-22, at 10:45am, I CSI, REDACTED observed the following noncompliance during slaughter operations, HATS category VIII. While stunning the third hog of the day, I heard two successive shots and saw Mr. REDACTED preparing for a third shot with the .22 rifle because the hog was still conscious. The third shot did not render the hog unconscious. Mr. REDACTED then reached for the .22 Magnum for the fourth shot which did successfully render the hog unconscious. Mr. REDACTED was verbally made aware of the noncompliance and this NR serves as official written notice. This is a noncompliance according to regulation 9CFR 313.16(a)(1).

On 7-12-22 at approximately 7:15am, I CSI, REDACTED, observed the following noncompliance while verifying HATS Category IV. In one pen, holding two beef, there was an 8 foot gate on the pen floor, allowing beef to walk across and through the bars at will. No injuries were observed. Owner, REDACTED , was notified of the non compliance and removed the gate immediately. This is a noncompliance according to 9 CFR 313.1(a).
