313.15(a)(1)
On 7/5/2023 at approximately 2219, while observing HATS Category VIII - Stunning Effectiveness, SPHV REDACTED observed the following noncompliance while performing ante-mortem in the subject pen with Supervisor REDACTED SPHV REDACTED instructed Supervisor REDACTED that hog 242 was condemned and needed to be stunned using the captive bolt gun. The hog was not restrained using a sort board as it was laterally recumbent up against the concrete wall and was only able to lift its head and attempt to sit up. Supervisor REDACTED applied the initial stunning attempt using the captive bolt gun; the device discharged, but the stun attempt was not effective as the hog began vocalizing, had normal head movement that included picking its head up and trying to keep it up, and there was blood on its forehead. When Supervisor REDACTED noticed that the hog was still conscious, he followed with an immediate second stun attempt with the back-up captive bolt gun. The back-up captive bolt device was properly loaded and staged. SPHV REDACTED observed the hog become unconscious on the second stun; there was no corneal reflex. Supervisor REDACTED was notified verbally and now in writing of the failure to comply with regulatory requirement 9 CFR 313.15(a)(1). Preventative measures will be outlined in the establishment’s written response to this NR.

HATS Category IV Ante Mortem Inspection On 11.02.2022 at approximately 0615 SPHV REDACTED observed the following noncompliance while performing ante mortem inspection. The entrance gate to pen 25 is lined on the inside with a wire hog panel. A wire of the panel had been broken loose approximately 18" above floor level and was protruding into the pen approximately 12". The pen contained 40 head of market hogs. Barn Leader REDACTED was shown the noncompliance. Barn Supervisor REDACTED was notified verbally and now in writing of the failure to comply with regulatory requirement 9CFR 313.1(a). Immediate corrective action was to remove the wire back to where it was still connected to the panel and smooth the removal site. Further preventative measures will be outlined in the establishment's written response to this NR.
